  1. ENQUIRY FORM AND CONTACT

You can use the enquiry form on our website to request information about the OTUS project, arrange a viewing or submit a general enquiry.

The following personal data may be processed:

– telephone number

– content of your message
– time of the enquiry
– technical information required for secure transmission

We require the information marked with an asterisk or otherwise identified as mandatory to process your enquiry and contact you. We may be unable to process your enquiry if this information is not provided.

Form submissions are processed through Squarespace and may be stored in the Squarespace Contacts panel. They are also forwarded to the email inbox used by us.

Enquiries sent to sales@otus.berlin and messages submitted through the enquiry form are processed by ASI Real Estate GmbH. The central inbox used for this purpose can be reached at office@albeck-schache.de. The use of this email domain does not alter the fact that ASI Real Estate GmbH is the controller responsible for processing OTUS enquiries.

If your enquiry is made with a view to entering into a contract or relates to an existing contractual relationship, processing is based on Article 6(1)(b) GDPR. General enquiries are processed on the basis of Article 6(1)(f) GDPR. Our legitimate interest lies in responding appropriately to and documenting business enquiries.

If no contract is entered into, we generally delete the data no later than six months after the enquiry has been fully dealt with. Data will be retained for longer only if statutory retention obligations apply, the data is required to establish, exercise or defend legal claims, or you have consented to longer retention.

If a contract is entered into, we retain the relevant data for the duration of the contractual relationship and thereafter in accordance with applicable statutory retention and limitation periods.

  1. SPAM PROTECTION AND GOOGLE reCAPTCHA

Squarespace uses a CAPTCHA service to protect the enquiry form against automated submissions, misuse and spam. Google reCAPTCHA or reCAPTCHA Enterprise may be used for this purpose.

This website uses Adobe Fonts to ensure the consistent display of typefaces. The provider for users outside North America is:

Within ASI Real Estate GmbH, access to personal data is limited to those individuals who require it to process the relevant enquiry or provide technical and administrative support.

OTUS enquiries are not disclosed to Albeck & Schache Investment GmbH merely because it is the shareholder of ASI Real Estate GmbH.

The use of Squarespace, Adobe Fonts and Google services may involve personal data being transferred to or processed in countries outside the European Union or European Economic Area, in particular the United States.

Personal data is transferred internationally only where the requirements of Articles 44 et seq. GDPR are satisfied. Where a recipient is certified under the EU-US Data Privacy Framework, transfers may be based on the European Commission’s adequacy decision pursuant to Article 45 GDPR. Otherwise, we use safeguards such as the European Commission’s Standard Contractual Clauses pursuant to Article 46(2)(c) GDPR or other safeguards recognised by law.

Despite these safeguards, processing in third countries may involve a residual risk that public authorities may access personal data under the laws applicable in those countries.

  1. RETENTION PERIODS

We retain personal data only for as long as is necessary for the relevant purpose.

When the purpose of processing no longer applies, the data is deleted unless statutory retention obligations, overriding legitimate interests or the need to establish, exercise or defend legal claims require continued retention.

Statutory retention periods may apply in particular to business correspondence, accounting records and tax-relevant documents and generally range from six to ten years.
